Status of the Software
Certum Draft is a personal, experimental software project. It is provided for testing and evaluation purposes only and may contain defects, errors, or security vulnerabilities.
No Legal (or Other Professional) Advice
Certum Draft does not provide legal advice and is not a substitute for professional judgment. No solicitor-client relationship (or other professional relationship) is created by your use of the software or any materials produced using it.
User Responsibility and Verification
You are solely responsible for reviewing, verifying, and approving all outputs generated using Certum Draft (including all documents, calculations, formatting, and metadata) before any use, signing, service, filing, exchange, settlement, lodgment, or reliance. You must maintain independent checks and controls appropriate to your circumstances, including backup and version control practices.
No Warranties
To the maximum extent permitted by law, Certum Draft is provided on an "as is" and "as available" basis, without warranties of any kind (express or implied), including any warranty of accuracy, reliability, fitness for a particular purpose, non-infringement, availability, security, or that use will be uninterrupted or error-free.
Limitation of Liability
To the maximum extent permitted by law, in no event will the developer be liable for any loss or damage arising out of or in connection with the software or your use of it, including indirect loss, consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, business interruption, or loss/corruption of data.
Liability Cap
To the maximum extent permitted by law, the developer's total aggregate liability for any claim arising out of or in connection with Certum Draft (whether in contract, tort, negligence, breach of statute, or otherwise) is limited to the greater of:
- One (1) Australian dollar; or
- The total amount (if any) you paid to access the software in the twelve (12) months before the event giving rise to the claim.
Data and Security
You acknowledge that no system can be guaranteed secure. You are responsible for assessing whether Certum Draft is suitable for any use involving confidential, privileged, personal, or sensitive information, and for implementing appropriate safeguards (including access controls, encryption, secure storage, and secure deletion).
Third-Party Components
Certum Draft incorporates third-party components which are subject to their own licence terms. Third-party components are provided by their respective licensors, and the developer is not responsible for third-party functionality, availability, or security.

Indemnity
You indemnify the developer against any claim, loss, damage, or expense (including legal costs on a full indemnity basis) arising out of or in connection with your use of Certum Draft, your reliance on outputs, or your breach of these terms, except to the extent caused by the developer's breach that cannot lawfully be excluded.
Australian Consumer Law
Nothing in this disclaimer purports to exclude, restrict, or modify any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law or other legislation that cannot be excluded.
Governing Law
This disclaimer is governed by the laws of New South Wales, Australia.
